I received an email asking me…

Mr. Constitution, does the constitution say it’s illegal for states to pursue election audits? Or what is this “new” guidance document that the DOJ have that says it would violate federal law to support state election audits and that anyone would face a year in prison if they pursue these audits. These audits are proving that the election was stolen from President Trump, how can the pretender and his DOJ attempt to get away with this. The constitution is to protect the people and their rights not to protect a fraud who cheated to win an election.

My response (unfortunately, a couple weeks after receiving the email because I am overwhelmed with thousands of emails waiting to be responded to):

Sorry it took a while to get back to you.  I am in “catch-up mode” when it comes to my email.

You asked if it was illegal/unconstitutional for States to pursue election audits.
Short answer: NO.
Here’s the details (I plan to do a video based on your question … video is below the text in this post … today, as well).
The Department of Justice first of all has no authority to even discuss this topic.  There is no mention of election audits in any part of the Constitution, which means the authority is not granted to the federal government, and not prohibited to the States, leaving the authority to be granted to the States (via the Tenth Amendment).  Any enforcement by the Department of Justice of their unconstitutional claim that the States are violating federal law if they pursue election audits should be responded to with lawsuits claiming that the federal government is overstepping its constitutional authority and that any and all threats regarding this matter are null and void.
