Gibbs, or any affiliate pages or websites are trademarks or trade dress of Douglas V. Gibbs in the U.S. and other countries.  Douglas V. Gibbs or Mr. Constitution trademarks and trade dress may not be used in connection with any product or service that is not directly associated with Douglas V. Gibbs unless for the purpose of promoting Mr. Constitution or Douglas V. Gibbs for the purpose of sharing information regarding the websites, public speaking engagements, classes, books, or other affiliated products or services by Mr. Constitution, Douglas V. Gibbs.

The aforementioned designs or properties of Douglas V. Gibbs may not be used in any manner that may cause confusion among customers, or in any manner that disparages or discredits Douglas V. Gibbs as a product or service supplier.  Political disagreement in the form of comments, opinion pieces, or other means that falls within reasonable debate or conversation is excluded from the aforementioned requirement.

Subject to your compliance with these Conditions of Use and any Service Terms, and your payment of any applicable fees, Mr. Constitution Shop by Douglas V. Gibbs or any affiliated pages, websites, or Douglas V. Gibbs himself grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the products and services available through or from Mr. Constitution Shop by Douglas V. Gibbs, or any affiliated pages or websites.  This license does not include any resale or commercial use of any product or service by Douglas V. Gibbs except what is allowed by law.  All rights not expressly granted to you in these Conditions of Use or any Service Terms, or any uses besides what is reasonably allowed by law, are reserved and retained by Douglas V. Gibbs and any affiliated pages, websites, suppliers, publishers, other services used in regards to processing any orders.  No Douglas V. Gibbs service, nor any part of any Douglas V. Gibbs product, may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of Douglas V. Gibbs, except where it is permitted by law.  Any services or processing of an order may be terminated if you do not comply with these Conditions of Use or any Service Terms.

We do not issue accounts, any attempt to purchase, utilize, or access any products or services by Douglas V. Gibbs is based on a per visit model.

You are responsible for maintaining the confidentiality of your interactions with this website, or affiliated pages, services, or websites.  If you are under 18, you may use purchase or access Mr. Constitution Douglas V. Gibbs services or products only with the involvement of a parent or guardian.  Douglas V. Gibbs reserves the right to refuse service, terminate services, or terminate your access to use Mr. Constitution Shop or any of Douglas V. Gibbs' products, services, or online presence based on his sole discretion.

REVIEWS, COMMENTS, COMMUNICATIONS, AND OTHER CONTENT

You may post reviews, comments, and other content or communications as long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights (including publicity rights), or otherwise injurious to third parties or objectionable, and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam" or unsolicited commercial electronic messages. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content.  Douglas V. Gibbs reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content.  Blog comments are manually moderated on a varying basis.

If you do post content or submit material, and unless we indicate otherwise, you grant Douglas V. Gibbs nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display such content throughout the world in any media.  If you provide information to any of the websites or services by Douglas V. Gibbs you grant to Douglas V. Gibbs the right to use the name that you submit in connection with such content, should Douglas V. Gibbs choose to use it.  You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Douglas V. Gibbs for all claims resulting from content you supply.  Douglas V. Gibbs has the right but not the obligation to monitor and edit or remove any activity or content.  Douglas V. RISK OF LOSS

All purchases of physical items from Mr. Constitution Shop by Douglas V. Gibbs are made pursuant to a shipment contract.  This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

RETURNS, REFUNDS AND TITLE

Constitution Shop by Douglas V. Gibbs does not take title to returned items until the item arrives at our shipping and processing center.  At our discretion, it is possible for a refund to be issued without requiring a return, but each decision regarding such an action is made on a case-by-case basis.  In this situation, Constitution Shop by Douglas V. Gibbs does not take title to the refunded item.  In all other cases, the refund will not be issued until the returned item has arrived at our shipping and processing center, and Constitution Shop by Douglas V. Gibbs has confirmed to the sender that the item has been received.

PRODUCT DESCRIPTIONS

Mr. Constitution Shop's product descriptions are as accurate as possible. However, if you believe your product, once it is received, is not as described, your sole remedy is to return it in unused condition, and a refund will be provided once the product is received and Mr. Constitution Shop by Douglas V. Gibbs has confirmed it has taken title of the returned product.

PRICING

"List Price" means the suggested retail price of a product as we have determined.  We reserve the right to change the price at any time, but the price paid will always be what was provided at the time of purchase.  If a price changes after purchase, but before delivery, the original price is the one honored, regardless of if the price increased, or decreased, after actual purchase.

We generally charge your credit card based on the terms of the merchant processing provider, which may be immediately, or after your order has entered the shipping process or, for digital products, until we make the digital product available to you.

SHIPPING

We currently only ship to addresses located within the United States, or an address that is related to U.S. mail services such as military APO/FPO/DPO (Army Post Office/Fleet Post Office/Diplomatic Post Office)​ addresses.  Currently, we do not mail internationally.  The books or Douglas V. Gibbs are also available at Amazon and Barnes and Noble if you are unable to purchase these items through Mr. Constitution Shop by Douglas V. Gibbs.  Any other products listed at Mr. Constitution Shop by Douglas V. Gibbs are only available through the Mr. Constitution Shop website.  International Shipping of physical products is expected to be online in the near future, but is not currently available.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

Products and services made available through Mr. Constitution Shop by Douglas V. Gibbs are made available on an "as is" basis, unless otherwise specified in writing.  There are no warranties of any kind, but if you are unhappy with your product or service a refund or replacement of the product or service may be made available on a case by case basis.  Otherwise, your purchase of products or services through Mr. Constitution Shop by Douglas V. Gibbs are made at your own risk.

DISPUTES

Any dispute or claim relating in any way to your use of any Mr. Constitution Shop by Douglas V. Gibbs product or service may be submitted in writing to Mr. Constitution Shop by Douglas V. Gibbs either at constitutionspeaker at yahoo.com or by physically mailing correspondence to Mr. Constitution Shop by Douglas V. Gibbs.  A mailing address may be provided by emailing us at constitutionspeaker at yahoo.com.  

APPLICABLE LAW

By using Mr. Constitution Shop by Douglas V. Gibbs you agree that applicable federal law, and the laws of the state of California, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Douglas V. Gibbs.

SITE POLICIES, MODIFICATION, AND SEVERABILITY

We reserve the right to make changes to our site, policies, Service Terms, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

If you believe there has been a copyright infringement, claims must include:

• A description of the copyrighted work that you claim has been infringed upon;
• A description of where the material that you claim is infringing is located on the site;
• Your address, telephone number, and e-mail address;
• A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
